1.AGREEMENT TO TERMS

By accessing or using the Snake River Sims website at snakeriver.golf, placing an order, or engaging our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use this site or place an order with us.

These Terms of Service constitute a legally binding agreement between you and Idaho Custom Courts LLC, doing business as Snake River Sims ("Snake River Sims," "we," "us," or "our").

2.WHO WE ARE

Snake River Sims is an assumed business name of Idaho Custom Courts LLC, a limited liability company organized under the laws of the State of Idaho, operating in the Treasure Valley, Idaho.

We manufacture and deliver prefab golf simulator studios, provide in-home simulator build-out services, and sell golf simulator hardware and accessories through our Pro Shop.

3.PRODUCTS AND SERVICES

We offer three primary lines:

Studio ONE and Prefab Golf Studios. Custom-manufactured golf simulator studios that are delivered and set up at your property. These are manufactured products, not construction services. Risk of loss transfers to the customer upon delivery and placement at the designated site.

In-Home Simulator Build-Outs. On-site labor services to design and build a golf simulator space within an existing structure. These are services, not products. Service terms are governed by any applicable statement of work or invoice provided at the time of engagement.

Pro Shop Hardware and Accessories. Golf simulator hardware, launch monitors, enclosures, screens, computers, and accessories sold through the Snake River Sims Pro Shop. Third-party products are subject to their respective manufacturer terms and warranties.

We reserve the right to modify, discontinue, or limit availability of any product or service at any time without prior notice.

4.ORDERING AND PAYMENT

All orders are subject to acceptance by Snake River Sims. We reserve the right to refuse or cancel any order at our discretion, including after confirmation, in which case any payment collected will be refunded.

Studio ONE requires full payment at the time of order. Payment constitutes acceptance of the order and authorization to begin the manufacturing process.

In-home build-outs require full materials payment upfront, with remaining labor due upon project completion, as specified in the applicable invoice or agreement.

Pro Shop orders require full payment at checkout prior to fulfillment.

Prices are listed in U.S. dollars. We reserve the right to correct pricing errors at any time. In the event of a pricing error, we will notify you and give you the option to confirm the order at the correct price or cancel for a full refund.

Sales tax will be calculated and applied where required by law.

5.DELIVERY AND RISK OF LOSS

For Studio ONE and prefab studios, delivery is to the address specified at the time of order. We will coordinate a delivery window with you in advance. You are responsible for ensuring site access, a suitable level surface, and any required permits or HOA approvals before delivery.

Risk of loss and title transfer to you upon delivery and placement of the studio at your property. Snake River Sims is not responsible for damage or loss occurring after delivery.

Delivery fees are non-refundable once a delivery has been scheduled or fulfilled.

For Pro Shop orders, risk of loss transfers to you upon carrier pickup from our facility or our supplier's facility. We are not responsible for carrier delays or damages in transit, though we will assist in filing claims where applicable.

6.RETURNS, REFUNDS, AND CANCELLATIONS

Returns, refunds, and cancellations are governed by our Refund and Return Policy, which is incorporated into these Terms by reference and available at snakeriver.golf/refund-policy. By placing an order, you acknowledge that you have read and agree to those terms.

7.WARRANTIES

Studio ONE structures and components are covered by a 1-year limited warranty against defects in materials and workmanship, commencing on the date of delivery. This warranty does not cover damage caused by misuse, improper maintenance, unauthorized modifications, acts of nature, or normal wear and tear.

Third-party products are covered solely by their respective manufacturer warranties. Snake River Sims makes no additional warranties, express or implied, with respect to third-party products.

Except as expressly stated above, all products and services are provided "as is" without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Idaho Custom Courts LLC and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our products, services, or website, even if advised of the possibility of such damages.

In no event shall our total liability to you for any claim arising out of or related to these terms, your order, or our products or services exceed the total amount you paid to us for the specific product or service giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

9.INTELLECTUAL PROPERTY

All content on snakeriver.golf, including but not limited to text, images, graphics, logos, and product descriptions, is the property of Idaho Custom Courts LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

10.USER CONDUCT

You agree not to use this website or our services to engage in any unlawful activity, transmit harmful or fraudulent content, or interfere with the operation of the site. We reserve the right to terminate access or cancel orders associated with any such conduct.

11.THIRD-PARTY LINKS AND CONTENT

Our website may link to third-party websites or feature third-party products and brands. These links are provided for convenience only. We do not endorse and are not responsible for the content, terms, or practices of any third-party sites.

12.GOVERNING LAW AND DISPUTE RESOLUTION

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms, your order, or our products or services shall first be submitted to good-faith negotiation. If negotiation does not resolve the dispute within 30 days, the parties agree to submit to the exclusive jurisdiction of the state and federal courts located in Canyon County, Idaho.

13.CHANGES TO THESE TERMS

We reserve the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Your continued use of the site or placement of an order after changes are posted constitutes acceptance of the revised terms.

14.SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

15.ENTIRE AGREEMENT

These Terms of Service, together with our Refund and Return Policy and any applicable invoice or statement of work, constitute the entire agreement between you and Idaho Custom Courts LLC with respect to the subject matter herein, and supersede all prior or contemporaneous communications and proposals.
